Welcome to DC Violinist. These Terms of Service ("Terms") govern your use of our website and the booking of live music entertainment services provided by DC Violinist, LLC ("DC Violinist," "we," "us," or "our"), a limited liability company operating in Washington, District of Columbia.

By accessing our website or booking our services, you ("Client," "you," or "your") agree to be bound by these Terms. Please read them carefully before proceeding with any booking.

1. Services Provided

DC Violinist provides professional live violin performance services for events including but not limited to weddings, corporate events, private parties, receptions, and other special occasions in the Washington DC metropolitan area and surrounding regions.

2. Booking and Reservations

2.1 Booking Process: All bookings must be confirmed in writing via email or through our booking system. A booking is not confirmed until you receive written confirmation from DC Violinist and a signed Performance Agreement.

2.2 Availability: All dates and times are subject to availability. We reserve the right to decline any booking request at our sole discretion. DC Violinist reserves the right to cancel any agreement without obligation upon written notice to the client prior to the deposit date.

2.3 Event Details: You must provide accurate and complete information about your event, including date, time, location, duration, performance requirements, and any special requests. Changes to event details must be communicated to us promptly in writing.

2.4 Conditions Precedent: Your obligations required to be met prior to the performance (including payment of deposit and balance, and providing venue access) are conditions precedent which must be satisfied in full before DC Violinist is required to perform, unless otherwise agreed to by all parties in writing. If you cancel, postpone, or fail to make any payment or perform any other condition precedent as required, you will be in breach of the agreement and DC Violinist will have no further obligations. You will forfeit any deposit already paid.

3. Payment Terms

3.1 Deposits: A non-refundable deposit is required to secure your event date. The specific deposit amount will be stated in your Performance Agreement and must be paid by the deposit date specified in the agreement.

3.2 Final Payment: The remaining balance is due no later than 30 days prior to the event date. For performances booked less than 30 days in advance, the full fee is due upon booking confirmation. Events will not be performed if final payment has not been received by the due date.

3.3 Payment Methods: We accept payment via check or money order made payable to DC Violinist LLC, as well as bank transfer, credit card, or other methods as agreed upon in writing. Checks should be sent to our business address.

3.4 Overtime: If agreeable to both parties, the performance time may be extended at an hourly overtime rate as specified in your Performance Agreement, to be paid prior to the overtime period.

3.5 Inclusive Fee: The performance fee is inclusive of all expenses, accommodations, and traveling expenses to and from the venue, except as expressly provided in your Performance Agreement.

4. Cancellation and Refund Policy

4.1 Client Cancellation:

  • Cancellation More Than 60 Days Prior to the Performance: If cancellation notice is received more than 60 days before the performance date, the client will forfeit the deposit already paid, and no further payment will be due.
  • Cancellation Between 30 and 60 Days Prior to the Performance: If cancellation notice is received between 30 and 60 days before the performance date, the client will be liable for 75% of the total fee. Any amount already paid, including the deposit, will be credited toward this liability.
  • Cancellation Less Than 30 Days Prior to the Performance: If cancellation notice is received less than 30 days before the performance date, the client will be liable for 100% of the total fee. Any amount already paid will be credited toward this liability.

4.2 Non-Refundable Deposit: The deposit, once paid, is non-refundable except as otherwise stated in this Agreement or required by law.

4.3 Cancellation by DC Violinist: DC Violinist reserves the right to cancel the performance without obligation upon written notice to the client prior to the deposit date. In the event DC Violinist cancels the performance under these terms, the deposit will be returned to the client promptly.

4.4 Force Majeure: Neither DC Violinist nor the client will be held liable for any failure to perform obligations under the agreement where such breach is due to acts or regulations of public authorities, labor difficulties or strike, inclement weather, epidemic, interruption or delay of transportation service, acts of God, or any other legitimate cause beyond reasonable control of either party.

5. Performance Terms

5.1 Performance Duration: Performance time includes the duration specified in your Performance Agreement. Additional time may be available at the hourly overtime rate specified in your agreement, subject to availability and mutual consent.

5.2 Set Lists and Repertoire: While we accommodate song requests where possible, the final repertoire selection is at the discretion of DC Violinist to ensure performance quality and appropriateness.

5.3 Breaks: For performances exceeding 90 minutes, we require a 15-minute break for every 90 minutes of performance time.

5.4 Setup Time: The venue must be available for setup and sound check at the time specified in your Performance Agreement, typically at least 30 minutes prior to the scheduled performance start time.

5.5 Weather and Temperature Conditions: DC Violinist will not be required to perform in conditions which could reasonably be expected to endanger the health or the physical or playing condition of instruments. The client agrees to make all reasonable efforts to ensure the following workplace conditions:

  • Indoor Venue: Acceptable temperature range is 62-82 degrees Fahrenheit
  • Outdoor Venue: Acceptable temperature range is 62-95 degrees Fahrenheit. Adequate shelter from rain and direct sunlight must be provided by the client.

DC Violinist will monitor temperature conditions during the performance. Should unacceptable conditions exist, our musicians may pause or leave the affected area without penalty until conditions improve. If conditions do not improve in a timely manner such that the performance stop time would be exceeded, and the performance has already begun prior to the onset of inclement weather, DC Violinist shall be paid the full balance due.

5.6 Substitution of Performers: DC Violinist is solely responsible for the selection of musicians to perform the engagement and reserves the right to make substitutions of personnel as necessary due to sickness, accident, or other legitimate cause. Any substitute musician will be of comparable quality and professionalism.

6. Client Responsibilities

6.1 Venue Access: You must ensure DC Violinist has access to the performance location at the setup time specified in your Performance Agreement for setup and sound check.

6.2 Sound and Lighting: DC Violinist's musicians will provide their own instruments and necessary stands. The client is responsible for providing adequate lighting and any sound amplification or PA system if required for the venue.

6.3 Electrical Power: The client is responsible for providing suitable power and electricity for the performance.

6.4 Parking: You are responsible for arranging and covering the cost of parking fees at the venue if applicable.

6.5 Safety and Security: You must take reasonable precautions for the safety of DC Violinist and our equipment during all aspects of the performance and at all times while we and our equipment are on the venue premises. You are also responsible for ensuring that only DC Violinist and its designated technicians and representatives are allowed on stage or in the backstage area.

6.6 Permits and Licenses: You warrant and represent that you have obtained any and all permits, approvals, licenses, and variances necessary for the performance.

6.7 Accuracy of Information: You represent that all information provided to us regarding your event is accurate and complete.

6.8 Labor Disputes: DC Violinist will not be required to cross a picket line established by a labor organization at the venue, and such refusal will not be considered a breach of this agreement.

7. Liability and Indemnification

7.1 Company Responsibility: DC Violinist is responsible only for its own conduct and the conduct of its performers.

7.2 Client Indemnification: The client is responsible for the conduct of its agents and guests and agrees to compensate and indemnify DC Violinist and its performers for any equipment damage, property damage, or personal injury resulting from the actions of the client, its agents, or its guests.

7.3 Limitation of Liability: DC Violinist's liability to you for any claims arising from or related to our services shall be limited to the total amount paid by you for the services. We are not liable for any indirect, incidental, consequential, or punitive damages.

7.4 Equipment Insurance: DC Violinist maintains insurance for our instruments and equipment. We are not responsible for damage to venue property unless caused by our gross negligence.

7.5 Third-Party Vendors: We are not responsible for the performance, actions, or omissions of any third-party vendors you engage for your event.

7.6 Independent Contractor Status: DC Violinist is an independent contractor and will control the manner and means of the performance. The client will control the scheduling of the performance. DC Violinist is not an employee of the client.

8. Intellectual Property and Recording

8.1 Copyright Compliance: DC Violinist specifically warrants and represents that all copyrighted material to be performed has been licensed or authorized by the copyright owners or their representatives. DC Violinist indemnifies the client for any copyright infringement and any expenses that may result from such copyright infringement during or as the result of the performance.

8.2 DC Violinist Recording Rights: DC Violinist and its designated performers reserve the right to record the performance for promotional and personal use. The client acknowledges that such recording does not infringe upon any rights related to the event.

8.3 Client Recordings: You may record or photograph our performance for personal use. Commercial use, reproduction, or distribution of recordings requires our prior written consent.

8.4 Marketing and Promotional Use: We reserve the right to use photographs and video footage from events for promotional purposes on our website and social media, unless you specifically request otherwise in writing prior to the event.

8.5 Signage Rights: DC Violinist shall have the right to display one (1) sign no larger than 2 feet by 3 feet attached to our equipment in a clearly visible location within the performance area. This sign may include our company name, logo, and a QR code linking to our official website or social media pages. The sign will be professionally produced and in keeping with the general aesthetic of the venue. We are responsible for the installation and removal of the sign, ensuring no damage is caused to the venue's property. The sign will not contain any offensive, discriminatory, or otherwise inappropriate material.

9. Safety Restrictions

9.1 Pyrotechnics: No pyrotechnic devices will be allowed during the performance. Violation of this provision will result in immediate cancellation of the performance and this agreement.

9.2 Legal Compliance: No part of the performance may consist of acts in violation of any local laws, codes, statutes, ordinances, regulations, rules, or any other requirements including building and fire regulations. If DC Violinist violates this section, the client may immediately cancel the performance and this agreement.

10. Conduct and Performance Standards

10.1 Professional Conduct: We expect all clients and guests to treat our performers with respect and professionalism. We reserve the right to terminate a performance immediately without refund if we are subjected to harassment, threats, or other inappropriate behavior.

10.2 Unsafe Conditions: We may terminate a performance if the venue becomes unsafe or if we reasonably believe that continuing the performance would pose a health or safety risk.

10.3 Good Faith: Both DC Violinist and the client agree to perform their obligations under this agreement, in all respects, in good faith.

10.4 Exclusivity: DC Violinist will perform exclusively for the client throughout the actual period of services unless otherwise provided by the client in writing. At the time of signing the Performance Agreement, DC Violinist will not be under any contract to a third party that might preclude us from fulfilling the requirements of the agreement.

10.5 Time is of the Essence: All parties acknowledge that time is of the essence in this agreement and all deadlines must be met.

11. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy. By booking our services, you consent to our collection, use, and storage of your personal information as described in our Privacy Policy.

12. Modifications and Execution

12.1 Changes to Terms: We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

12.2 Entire Agreement: These Terms, together with any Performance Agreement and our Privacy Policy, constitute the entire agreement between you and DC Violinist regarding our services and supersede all prior agreements and understandings, whether written or oral. This agreement cannot be changed except by written instrument subsequently executed by the parties.

12.3 Counterpart Execution: Performance Agreements may be executed in counterpart. Facsimile signatures are binding and are considered to be original signatures.

12.4 Notice of Changes: Material changes to these Terms will be communicated to you via email if you have an upcoming booking.

13. Governing Law and Jurisdiction

13.1 Governing Law: These Terms and any Performance Agreement shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions.

13.2 Jurisdiction: DC Violinist and the client each submit to the exclusive jurisdiction of the courts of the District of Columbia for the enforcement of this agreement or any arbitration award or decision arising from this agreement.

14. Entire Agreement and Superseding Terms

These Terms, together with any Performance Agreement and our Privacy Policy, constitute the entire agreement between you and DC Violinist regarding our services and supersede all prior agreements and understandings, whether written or oral. All negotiations and understandings have been included in these Terms and your Performance Agreement. Statements or representations which may have been made by either party in the negotiation stages may in some way be inconsistent with this final written agreement. Only the written terms will bind the parties.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

17. Notices and Delivery

Any notices or delivery required under this agreement will be deemed completed when hand-delivered, delivered by agent, or seven days after being placed in the mail, postage prepaid, to the parties at the respective addresses contained in the Performance Agreement or as the parties may later designate in writing.

19. Successors and Assigns

This agreement and the terms and conditions contained herein apply to and are binding upon DC Violinist's successors, assigns, executors, administrators, beneficiaries, and representatives, and the client's successors and assigns.

20. Acknowledgment

By booking our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and any Performance Agreement entered into with DC Violinist, LLC.
